What are HOA Covenants?

The Windsor Woods HOA Covenants are a shared set of standards that protect the character, appearance, and long-term value of our neighborhood. They outline clear expectations for property use, maintenance, and community conduct so that all residents can enjoy a well-kept, consistent, and respectful living environment.

These covenants are not about control for its own sake. They exist to balance individual freedom with collective responsibility, ensuring that decisions made today do not negatively impact neighbors or the community as a whole. By purchasing a home in Windsor Woods, owners agree to uphold these standards for the benefit of everyone in the neighborhood.

What are Windsor Woods Covenants?

Windsor Woods was platted and developed in 7 separate sections. Each time a new section was developed, a new Plat and Covenants were recorded. The Covenants have been amended from time to time to keep the full neighborhood under similar covenants. The sections and ordered have changed from time to time. Each section has “DEDICATION, PROTECTIVE RESTRICTIONS, COVENANTS, LIMITATIONS, EASEMENTS AND APPROVALS”. This document will try to succinctly summarize the covenants for general consumption. The actual language for each of the sections can be found below.

What is the Generalized Summary of Covenants?

1. Lot shall have a detached, single-family dwelling for residential purposes. Must have 2 car garage and cannot exceed 2.5 stories.

2. Easements for the installation and maintenance of utilities and drainage exist as shown on plats and on the rear 7’ of every lot (if not platted as larger).

“The removal of any obstruction by any utility shall in no way obligate the utility in

damages or to restore the obstruction.”

3. “No structure of a temporary character. trailer, boat, boat trailer, camper or camping trailer, basement, tent, shack, garage, barn or other outbuilding shall be either used or located on any lot at any time or used as a residence, either temporarily or permanently.”

No separate sheds or outbuildings allowed.

No trailers, boats, RVs etc. (unless stored inside garage)

4. No ATV, snowmobile, golf cart, moped, or any other motorized vehicle shall be operated in any area of the Subdivision except for the lawful operation of licensed motor vehicles within the streets. No motorized watercraft or vehicle shall be permitted on the lake.

5. No Signs except for sale/rent signs.

6. No livestock, poultry, or animals except household pets.

7. No wells or septic.

8. Architectural control committee established to review building/lot changes.

9. No Chain Link Fence (County ordinance only up to 8’ in height)

10. No Above-ground Pools that exceed 18” in height.

11. Trash/Recycle containers shall be located in garage or shall be fully screened from public view.

What is the Fort Wayne City and/or Allen County Code for Properties (Good Neighbors)?

1. Grass shall not exceed 9”.

2. Sidewalks:

- Shovel snow on sidewalks on your lot. (Every street has a bus stop)

- Do not let the sidewalk fall into disrepair.

3. Vehicles shall be registered and plated to be on the street or in the driveway.

- (Project vehicles can be in garage)

4. Noise Ordinance

- Lawn equipment, power tools: 7am – 9pm allowed.

- Music/PA: 7am – 10pm allowed.

5. Don’t have bright lights shining into your neighbor’s residence.

6. Pools

- Draining pool requires zero chlorine level and no chemicals added for 1 week.

- Pool drainage shall not leave your property.

- “Sanitary is best” (pump to sanitary drain; do not open a manhole)

7. Fences

- 4’ minimum for in-ground pools without automatic cover

- 8’ maximum for R-1 zoning

Why is the Board Unifying the Covenants?

This is all about modernizing our association to create efficiencies in management, reduce costs, and create a better community for our neighborhood. Windsor Woods was developed in seven separate sections, each with its own recorded covenants. Over time, this created confusion and inconsistency, even though we are one neighborhood and one Association. The Unified Declaration will combine those seven documents into one clear, consistent set of covenants that applies across Windsor Woods.
